SPARTAN GUARDIAN 90-Day Limited Parts Warranty

The SPARTAN GUARDIAN comes with a 90-day limited replacement parts warranty to the original purchaser of a new SPARTAN GUARDIAN product (the “Product”) against defects in materials and workmanship for a period of ninety (90) days from the date of receipt. This warranty is not transferable. If the Product covered by this warranty is determined to have a defective part or to be missing an essential component within the warranty period, the manufacturer will, unless otherwise required, send the missing part at its sole option and at its sole discretion. In no event may the Product or any of its constituent parts be used for any purpose other than as a component of the Product sold to the customer who purchased such Product.

Exclusions

This limited parts warranty provides coverage to the original retail purchaser and does not apply to borrowed, business, commercial, institutional, or other unauthorized uses. This limited warranty does not apply to any Product that was: (i)  any time, used as a demonstration model; (ii) purchased “as is” or second-hand; (iii) purchased at a distress sale or a going-out-of-business sale; or (iv) purchased from a liquidator. All warranties, whether express or implied, cover only normal, authorized usage. No warranty, express or implied, applies to any condition resulting from misuse, abuse, delivery or transportation damage, nor any condition resulting from incorrect or inadequate maintenance, cleaning or care. This warranty does not cover, for example: abuse of the Product, theft, accident, protective coatings, cosmetic damage (e.g. scratches, dents, cracks), damage caused by use with other products, damages from shipping, improper use or operation, lack of reasonable use, misuse or disassembly, modifications or alterations, normal wear and tear or aging.

Shipping

This limited warranty does not cover shipping charges incurred by any means. Retailers or customers must arrange for shipping under all circumstances.

Claim Procedure for Parts Warranty

If a problem should arise which you feel is covered by our limited warranty, contact the authorized retailer from whom you purchased your Product. Please make sure any claim for warranty service is accompanied by all relevant information necessary to satisfy the warranty requirements, such as the date of the part failure, a description of the event where the failure occurred, and whether the part failure occurred more than once. If a warranty claim has been demonstrated, the retailer will contact the manufacturer to establish any necessary or required service to the Product. The manufacturer reserves the right to require that defective parts be returned upon request or proper proof (e.g. images, video) be provided for any claim. The manufacturer is not responsible for scheduling or the cost of transporting your Product or its replacement parts from your home to the retailer or from the retailer to your home. You must make those arrangements with the retailer.

Disclaimer

No other express warranty has been made or will be made on behalf of the manufacturer with respect to the Product, its parts, or the operation, repair, or replacement of the Product and its parts. Furthermore, no representative of the manufacturer or its distributors or retailers is authorized to make any changes or modifications to these limited warranties.

Some retailers offer extended or additional warranties either from the retailer or through a third party. The manufacturer shall not be liable for any extended or additional warranties offered by any retailer or through a third party. In no event shall the manufacturer be responsible for consequential or incidental damages, such as loss of use, inconvenience, loss or damage to personal property, whether indirect or direct, and whether arising in contract or tort. In no event shall the manufacturer’s responsibility or damages exceed the purchase price of the Product part or its replacement.

Legal Rights

This warranty gives the owner specific legal rights, and you may have other rights, which may vary from state to state.

SPARTAN GUARDIAN Limited Manufacturer’s Warranty

The manufacturer warrants the Product to be free from defects in workmanship and materials, under normal use and conditions, for a period of one (1) year from the original invoice date. Shipping and handling fees are to be paid for by the customer. The manufacturer agrees, at its option during the warranty period, to repair any defect in material or workmanship or to furnish a repaired or refurbished product of equal value in exchange without charge, except for a fee for shipping, handling, packing, return postage, and insurance which will be incurred by the customer. Such repair or replacement is subject to verification of the defect or malfunction and proof of purchase, as confirmed by showing the model number on the original dated sales receipt.

Exclusions

This limited manufacturer’s warranty does not include: (i) any condition resulting from ordinary wear and tear or any use for which the Product was not intended; (ii) any condition resulting from incorrect or inadequate maintenance or care of the Product; (iii) any Product damage resulting from misuse, abuse, theft, negligence, accidents or shipping damage; (iv) dissatisfaction due to buyer’s remorse; or (v) damage incurred during transportation.

The Manufacturer makes no other express or implied warranty or condition, whether written or oral and expressly disclaims all warranties and conditions not stated in this limited warranty. To the extent allowed by the local law of jurisdictions outside the United States, the manufacturer disclaims all implied warranties or conditions, including any implied warranties of merchantability and fitness for a particular purpose. For all transactions occurring in the United States, any implied warranty of condition or merchantability, satisfactory quality, or fitness for a particular purpose is limited to the duration of the express warranty set forth above. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion of limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of this limited warranty may not apply to the customer. For consumer transactions, the limited warranty terms contained in this statement do not exclude, restrict, or modify but are in addition to the mandatory statutory rights applicable to the sale of the Product to the customer.

All warranty claims must be filed by the customer with the retailer of the Product, who in turn is to contact the manufacturer regarding any warranty return or replacement. We will not handle claims from the customer directly. Please retain invoices for a minimum of one year for warranty purposes.

Claims Procedure for Manufacturer’s Warranty

All claims for a defective Product must be made within ONE year from the invoice date and all Products that are claimed to be defective must be packed and returned in the original packaging.

The manufacturer reserves the right to require that items be returned to the original warehouse for inspection or be inspected by a designated representative in the field. In no event shall the manufacturer’s responsibility or damages exceed the purchase price of the Product or its replacement.

Pictures are required for any claims relating to a defective Product, along with a copy of the original invoice. If the claim is justified, the Product will be repaired or replaced, or a credit will be issued. It is our policy to replace Products whenever possible.

This warranty gives you specific legal rights. You may have other rights, which vary from state to state.
